The homeowners of San Francisco’s Presidio Terrace neighborhood are putting together a legal team to win back the private street they lost to a San Jose couple.

Presidio Terrace homeowners fell 30 years behind on property taxes, each not paying the $14 annual bill on their gated private street and sidewalks. Unknown to the wealthy residents, the city put the street on the online auction block, where Michael Cheng and Tina Lam outbid several other interested buyers to buy it for $90,100. As owners, the couple could theoretically charge the homeowners to park their cars on their own street. The residents didn’t hear the news until a representative of the buyers contacted them regarding a possible sell-back.

While the showdown before a Board of Supervisors is still a couple months away, Supervisor Aaron Peskin has already stated that it is unlikely the sale of the street will be rescinded unless the team can clearly show that procedures were not followed properly during the transaction.

The Presidio Terrace Homeowners Association’s legal team includes a former assistant city attorney and a former spokesman for the city attorney’s office.

The main target of the homeowners association is the tax collector’s office. According to the homeowners, the office was sending property tax bills to an accountant who retired in the 1980s. Then, the office failed to notify them about the auction. But the treasurer’s office counters that the city did nothing wrong.

The supervisors’ hearing will be held on November 28, 2017.
